Bad in So Many Ways

          When voters tossed him out Steve Driehaus was convinced it was because some people lied when they said he voted for taxpayer-funded abortions.  With the help of a former official at Planned Parenthood, he sued for “loss of livelihood.”  Driehaus had been know as a pro-life conservative Democrat in Ohio, but when he voted for Obamacare the Susan B. Anthony List (SBA List), a pro-life organization, tried to buy billboards in his district saying, “Shame on Steve Driehaus! Driehaus voted FOR taxpayer-funded abortion.”  Many on the left deny that Obamacare will pay for abortions, but since the law has yet to be fully implemented that issue is far from decided.  However, with the help of Judge Timothy Black, an Obama appointee and former president and director of Planned Parenthood, Driehaus is suing. 

          In October of last year, Driehaus sought an injunction with Ohio Elections Commission (OEC), stating that the advertisements were false and violated Ohio election law.  In a probable cause hearing, the OEC ruled in favor of Driehaus.  The politician then persuaded the billboard company not put up the SBA List advertisement.  Driehaus lost the election anyway. 

          Eventually this whole mess ended up before Judge Black in federal district court.  He ordered that the SBA List to remove from their website claims that Obamacare will fund abortions stating, “The express language of the PPACA (Obamacare) does not provide for tax-payer funded abortion. That is a fact, and it is clear on its face.Judge Timothy Black

          One has to wonder how Judge Black will be impartial in a case where the SBA List is seeking to defund Planned Parenthood, the organization Black, as president and director, sought to promote.  As one writer put it, “As seeming conflicts of interest go this one is a real humdinger.

          What Driehaus is attempting to do is bad, but what Judge Black is doing is bad in some many ways.  Whether Obamacare will pay for abortions or not, in a political campaign candidates must be allowed to say that their opponent’s plans or ideas are bad, even if they can’t prove it.  Anything less restricts free speech and stifles political debate.  Voters must decide what is true—not courts.      

          I can’t prove it until the law is fully implemented and the government actually does it, but this blogger is already on record as saying that since Obamacare does not explicitly ban abortion funding, courts will rule that it allows abortion funding.  Mark my words, Obamacare will fund abortions.  Even if I am completely wrong, I retain the right to speak my mind on the possible consequences of a government act.  Judge Black’s decree stifled free speech and abridged the rights of Americas when he required the SBA List to take down their views on Obamacare from their own website.  If it is the courts that decide what may be posted, printed or said we are no longer free.    

          Finally, Judge Black should have recused himself from this case because of his past ties to Planned Parenthood.  When he took the case, Black became not a judge, but an oligarch in a black robe.  He is not ruling on the law, he is creating the law he wants with each stroke of his judicial pen.

For what in God sake are they going to support abortions??They already know that it would be a great mistake. If the judge is like that, he really doesn't deserve to be a judge.
